Terms of Service

1. Agreement to Terms

By accessing or using Automated Exam (the "Service" or "automatedexam.com"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the Service.

2. Plans, Access Durations, Fair Use Policy, and Data Retention

We offer access to our premium features on a plan basis (Pro and Enterprise) available in 1-day, 1-week, 1-month, and 1-year access durations:

• One-Time Payments & Access Durations: All access plan purchases (1 Day, 1 Week, 1 Month, 1 Year) are one-time, non-recurring payments. Payments are processed securely via PayMongo (QR Ph, GCash, Maya, Bank Apps), Paddle (Cards, PayPal), or direct GCash Manual transfers verified by admin. Fixed-term access automatically expires at the end of the selected period, returning your account to the FREE tier.
• Exam Generation & Usage Quotas:
  • Free Tier (₱0): Limited to 1 Exam Generation (up to 10 items) and 10 AI items lifetime.
  • 1-Day Pass (₱30): Allows up to 5 Exam Generations (Download TQ) in 24 hours and 50 AI items & tweaks. Includes 5 concurrent active live exams (up to 100 learners/exam).
  • 1-Week Pass (₱99): Allows up to 35 Exam Generations (Download TQ) in 7 days and 500 AI items & tweaks. Includes 10 concurrent active live exams (up to 100 learners/exam).
  • 1-Month Pass (₱299): Allows up to 100 Exam Generations (Download TQ) in 30 days and 2,000 AI items & tweaks under our Fair Use Policy (FUP).
  • 1-Year Pass (₱1,999): Allows up to 2,000 Exam Generations (Download TQ) per year and 30,000 AI items & tweaks under our Fair Use Policy (FUP).
  • Gifted PRO (Complimentary): Granted via admin provision with custom expiration. Subject to daily Fair Use Policy limits of 12 Exam Generations (Download TQ) and 100 AI items per 24 hours, and up to 10 concurrent active live exams (up to 200 learners/exam).
• Data Retention Guarantee: All items, exams, and content created during an active paid subscription remain permanently saved in your personal account database. Upon subscription expiry, your Item Bank switches to Read-Only mode for existing items, and adding new items will pause if your total items exceed the Free Tier 200-item threshold.
• File Upload Safety & Size Limits: To prevent server degradation and browser memory crashes, spreadsheet (Excel/CSV) imports are strictly capped at 5MB per file and a maximum of 500 rows per import batch.
• Offline Device Storage & Cache Clearing Warning:
  • Cloud-Synced Data (Permanent): All account profiles, created item banks, saved test papers, and submitted exam results are stored safely on our cloud servers. Logging in on any device restores your cloud data even after clearing cache or reinstalling the app.
  • Local Device Data (Temporary & Unsynced): The platform utilizes browser LocalStorage and IndexedDB to enable offline test generation and offline exam recovery. Clearing browser cache, resetting site storage, or clearing app data before syncing will permanently delete local unsynced data, including: (1) unsubmitted offline student exam attempt drafts, (2) pending offline QR-scanned student answer batches, (3) offline-cached item bank copies, and (4) unsaved test generator drafts. Users are advised to sync all offline scans to the server before clearing browser data or uninstalling app storage.
• Recommended Data Backup & Retrieval Guidance:
  • Backing Up Item Banks: Navigate to your Item Bank dashboard and click Export All (Excel / JSON) to download a complete offline file backup to your local computer.
  • Restoring Backups: If you switch computers or reset browser data, log into your account and use the Smart Importer (Upload Excel/CSV) under the Item Bank to instantly reload your saved item banks.
  • Backing Up Exam Results: Under Live Exam Management, click Export Results to save student grade reports, item analysis data, and score spreadsheets locally.
  • Syncing Pending Scans: Always tap Sync Pending Scans in offline scanner mode when connected to the internet to upload offline student answer sheets to the cloud database before clearing site data.

3. Account Registration, Responsibility, and Communications

To use certain features of the Service, you must register for an account. You represent and warrant that all information provided during registration is accurate. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

By registering an account, you consent to receive communications from Automated Exam at your provided email address regarding: (1) technical support and account inquiries, (2) system maintenance and critical platform update announcements, and (3) product offers or feature releases (from which you may opt out at any time).

4. Acceptable Use and Content Policies

As an educational platform, you agree to use the Service solely for legitimate academic and administrative purposes:

• You will not upload or generate content that is unlawful, harmful, offensive, or violates intellectual property rights.
• You are solely responsible for the exams, questions, and items you generate, share, or administer.
• Attempting to bypass anti-cheat protections, scraping the service, or distributing test content unlawfully is strictly prohibited.

5. Intellectual Property Rights

The Service, including its design, algorithms, templates, and trademarks, is the property of Automated Exam and is protected by copyright and intellectual property laws. You retain ownership of any exam questions, school registries, and student data uploaded by you.

6. Limitation of Liability

In no event shall Automated Exam be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of, or inability to use, the Service, including but not limited to loss of data, exam interruptions, or administrative errors.

7. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe you have breached these Terms of Service.
